Welcome to Top Pest Control BD. By accessing our website, using our "Certificate Check" portal, or engaging our services, you agree to comply with and be bound by the following Terms and Conditions ("Terms").If you disagree with any part of these terms, please discontinue use of our website and services.

Definitions

1. "Company," "We," "Us": Refers to Top Pest Control BD.
2. "Client," "You": Refers to the organization or individual engaging our services.
3. "Services": Refers to Pest Control, Policy Development, Inspections, and Certification Support provided by Top Pest Control BD.

Scope of Services & Audit Limitations

1. Nature of Services & Audits: Our pest control services and hygiene audits are conducted based on inspections and sampling at a specific point in time. While we aim for accuracy, they do not guarantee the complete absence of pests, non-conformities, or violations.
2. Accuracy of Information: Clients are responsible for providing complete and accurate information during inspections and audits. Top Pest Control BD is not liable for conclusions based on incorrect, incomplete, or withheld information.

Booking & Payment Terms

1. Invoicing: Invoices will be issued upon agreement of the service scope.
2. Payment: Full payment is due within [e.g., 7 or 15] days of the invoice date or as specified in the service contract.
3. Refunds: Fees for services already rendered (e.g., an audit day that has taken place) are non-refundable.
4. Taxes: All fees are exclusive of VAT and Tax unless otherwise stated. The Client is responsible for applicable government levies.

Use of Certificates & Logos

1. Validity: Certificates issued by Top Pest Control BD remain valid only if the Client maintains the required services (if applicable).
2. Verification: The status of any certificate must be verified via our website's Certificate Check portal. We are not responsible for forged documents not validated by our system.
3. Misuse: You may not alter, modify, or falsify Top Pest Control BD certificates. If a client is found misrepresenting their certification status (e.g., claiming to be certified when suspended), we reserve the right to revoke the certificate and take legal action.

Confidentiality & Intellectual Property

1. Client Data: We agree to keep your proprietary business data (processes, trade secrets) confidential, sharing it only with accreditation bodies as strictly necessary.
2. Top Pest Control BD Material: Audit checklists, training materials, and report templates provided by Top Pest Control BD remain the intellectual property of Top Pest Control BD. You may use them for internal compliance but may not resell or distribute them.

Limitation of Liability

To the fullest extent permitted by law, Top Pest Control BD shall not be liable for any indirect, incidental, or consequential damages resulting from:

1. The use or inability to use our services.
2. Decisions made by third-party certification bodies.
3. Operational failures or accidents occurring at the Client's site after an audit has been conducted.

Our total liability for any claim arising out of our services shall not exceed the total amount paid by the Client for that specific service.

Termination

We reserve the right to terminate services or revoke certification immediately if:

1. The Client fails to pay invoices.
2. The Client violates ethical standards or attempts to bribe auditors.
3. The Client fails to correct major non-conformities within the agreed timeframe.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes relating to these terms will be subject to the exclusive jurisdiction of the courts of Bangladesh.
